Wake Superior Court Rules Annexation Petitions Unconstitutional

An order signed March 27 by a Wake County Superior Court judge declared S.L. 2011-173 and 177 (laws applying the veto petition from the newly enacted annexation reform law to active annexation processes in Rocky Mount, Wilmington, Kinston, Fayetteville, and Lexington, and retroactively to previously annexed areas in Goldsboro), and portions of the overall annexation reform bill (S.L. 2011-396) unconstitutional under provisions of the NC Constitution. A copy of the order is referenced below.
 
While the League was not a party to these proceedings, we understand the concerns of municipal residents in these towns, and the commitment of elected town officials to pursue a fair and balanced result for their citizens. We respect the General Assembly's need to enact reasonable and constitutional annexation reforms impacting city and non-city residents, and stand ready to continue to work with legislators to meet those goals.
